1. Eligibility and acceptance
You must be at least 18 years old and able to enter a binding agreement to create an account. If you use NookFox for an organization, you represent that you have authority to bind it. Do not use the service if you do not agree to these Terms.
2. Your account
Provide accurate account information, keep your credentials secure, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless caused by a NookFox security failure.
3. The service
NookFox provides tools for organizing links, tasks, calendars, messages, and related information. Features may change as the service develops. We may modify, suspend, or discontinue a feature when reasonably necessary and will provide notice of material changes when practical.
4. Your content
You retain ownership of content you submit. You grant NookFox a limited, non-exclusive license to host, process, display, transmit, back up, and otherwise use that content only as needed to provide, secure, support, and improve the service. You represent that you have the rights needed to submit the content.
5. Acceptable use
Do not use NookFox to break the law; violate another person's rights; distribute malware or harmful material; harass or exploit others; access another account without permission; probe or bypass security; overload the service; scrape it at unreasonable volume; or resell access without written permission.
6. Connected services
Optional integrations are also governed by the third party's terms and privacy practices. You authorize NookFox to access and process connected-service information only for the features you request. You may disconnect an integration, although previously imported information may remain until you remove it or request deletion.
7. Free and future paid plans
Free features are provided without charge. Before any paid purchase, NookFox will show the exact amount due that day, billing period, renewal price, renewal date, and any credit or savings. Paid plans renew automatically only after you authorize payment. You may turn off renewal at any time; access continues through the paid-through date and voluntary cancellation does not create a prorated refund. When paid access expires, the account moves to the Free plan instead of being erased. Account and billing history and genuine transaction receipts remain visible while the account is accessible. We will not charge you without your authorization.
8. Privacy
Our Privacy Policy explains how NookFox handles personal information. It is incorporated into these Terms by reference.
9. Closing, suspension, and termination
You may close your account at any time. Closing signs you out, revokes active sharing, and makes the account unavailable; it does not promise immediate deletion. You may separately request deletion of personal information, subject to information we reasonably retain for security, legal compliance, disputes, and recordkeeping. We may restrict or terminate access for a material or repeated breach, unlawful conduct, nonpayment, a security risk, or conduct that harms users or the service. When practical, we will provide notice and an opportunity to correct the issue.
10. Disclaimers
NookFox is provided “as is” and “as available.” To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise uninterrupted or error-free operation, and NookFox is not a substitute for emergency, medical, legal, financial, or other professional services.
11. Limitation of liability
To the extent permitted by law, NookFox will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill. NookFox's total liability arising from the service will not exceed the greater of $100 or the amount you paid NookFox during the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law.
12. Governing law and disputes
Colorado law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, contact us and allow 30 days for an informal resolution. Any proceeding not resolved informally will be brought in a state or federal court with jurisdiction in Colorado, unless applicable law requires otherwise.
13. Changes
We may update these Terms as NookFox or legal requirements change. We will update the effective date and provide reasonable notice of material changes. Continued use after the effective date of revised Terms means you accept them; if you do not agree, stop using the service.
